1. General

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as “you” or “the customer”) with Equestrian Stockholm AB, hereinafter referred to as “Equestrian Stockholm”, “us”, or “we”, at the Equestrian Stockholm website.

By using www.esstockholm.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the “Terms”). Please make sure you have read and understood the Terms before placing your order.

Only persons of legal age, 18 or older depending on your place of residency, who are not under guardianship, and are not acting in capacity as a company, with a physical address in one of the countries that Equestrian Stockholm provides deliveries to, can place an order.

The Terms might be amended from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on www.esstockholm.com at the time you place your order. You should carefully read them prior to placing any order.

2. Prices and delivery charges

The prices displayed at www.esstockholm.com include VAT for customers located in the EU & UK but do not include a delivery charge. The price does not include import taxes, custom duties, or import VAT that may occur. Import taxes/custom duties will be charged by your carrier at delivery and Equestrian Stockholm does not compensate these charges.

If the value of your order exceeds the toll-free limit in your market extra fees will be applied upon delivery. Please check with your local customs office for more information.

We reserve the right to make price adjustments, changes in stocks, and obvious typographical errors. Equestrian Stockholm cannot be held responsible for circumstances where we have no control.

The delivery charge for each order will be the same, regardless of the size or weight of your order. The cost for delivery is clearly indicated during the check-out process. If the package is not collected upon delivery, we will charge you for upcoming costs. If we are unable to deliver your order in full and must make more than one delivery, there will not be an additional charge for any subsequent deliveries. The products will be at your risk from the time of delivery.

3. Ordering/conclusion of contract

The ordering option available to you is via www.esstockholm.com. Once you have added all the items you wish to purchase to your basket and finished shopping, your next step will be to go through the checkout process and make a payment. To do this:

Click on the cart icon at the top right of the page.

Click on the “Proceed to checkout” button at the bottom of the page.

Fill-in or check your contact details, the details of your order, the delivery address, and the billing address.

Choose your method of payment and fill in the payment details.

Click on the “Pay order” button.

Your card details will be encrypted to minimize the possibility of unauthorized access or disclosure. Authority for payment must be given at the time the order is made. By clicking “Pay order” you are confirming that the card used is yours. The amount authorized by you will not be taken until your order is dispatched for delivery. If payment is made via PayPal the amount will be charged upon confirmation of your order. Cards are subject to validation checks and authorization by your card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery.

Once you have placed your order, you will receive an email confirmation to the email address you have supplied us with within 24 hours after the order is received by Equestrian Stockholm. Equestrian Stockholm will fulfil the order in accordance with the email confirmation. If for any reason we are unable to fulfil your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, we will notify you and ask you to contact Equestrian Stockholm Customer Service who will settle the refund.

4. Delivery

Equestrian Stockholm exercises the utmost diligence in accepting and processing orders and will strive to deliver your order in accordance with your selected delivery option.

Equestrian Stockholm strives to dispatch orders in the fastest possible time and in the order in which they are placed. Before you place your order, you will be informed of the expected delivery details. Once you have placed your order you will receive an email confirmation with your expected delivery details. Orders may be delivered within 2-10 business days.

“Business days” in this sense refer to Monday-Friday.

Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. If your order does not arrive by the scheduled date, please contact Equestrian Stockholm Customer service https://esstockholm.com/faq. In the unlikely event the delivery time exceeds 30 days from the date your order has been shipped, you may cancel your order at no cost.

It may happen that all stocked items are sold out before we can update the site. In this case, we will contact you with more information and a new estimated delivery schedule. You have the right to cancel the purchase at no cost if the item is not in stock.

5. Withdrawal of Order

To withdrawal an order after an order has been placed, the customer must contact Equestrian Stockholm Customer Service at info@equestrianstockholm.com. There is no guarantee that an order can be withdrawn if the order has already been packed and scanned by a courier.

You may return your order up to 30 calendar days after your order has been delivered to you. Please note that you will bear the cost of the return of the items to Equestrian Stockholm, unless otherwise stated by your local customer rights legislation. You will find the full Returns Policy at www.esstockholm.com here https://returns.esstockholm.com. Customers pay for the return cost.

If you wish to return your order, please visit our return portal https://returns.esstockholm.com and follow the instructions. You can also provide us with notice by filling in and submitting the standard form issued by your local Consumer Rights Authority. You will have to return the item(s) to us as set out in section 6 (Returns) below within the 30-day period set in section 5 above. We will provide a refund attempting to use the same method used to make the payment (or, if the items have not yet been paid for, reflect the return of the items in your account balance) as soon as possible and at the latest within 30 calendar days of receiving your notice of cancellation, provided we have received the items or evidence of you having sent back the items. Another payment method may be used for the refund, provided that you consent to such a change; in any case this will not generate any additional charges.

If the item you have received is defective, please notify Equestrian Stockholm promptly and return the item in accordance with section 6 (Returns) below. Equestrian Stockholm will, for any products deemed defective, provide a full refund.

6. Returns

Equestrian Stockholm guarantees a full refund for any returned items in accordance with section 5 (Withdrawal of Order), provided that all items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, washed, altered, or worn (other than to try the item on) and that any labels or tags should be intact and should not be removed.

Equestrian Stockholm is not responsible for currency fluctuations that occur when issuing refunds. We will not refund any bank charges.

7. Disclaimer

We reserve the right to change prices as a result of large price deviations from our suppliers, typos or other errors beyond our control. Read more about unforeseen events under Force Majeure below.

8. Payment methods

You can pay for your goods as set out below.

You can enter your payment details at the time you place your order. Equestrian Stockholm accepts payments made via a valid credit or debit card (VISA or Mastercard), Klarna, PayPal (possible with Amex) and gift cards. Customers need to be registered at PayPal for using this method of payment. More information can be found on PayPal’s website. We display our products in Euros. Equestrian Stockholm has ownership and withdrawal rights to all products until full payment has been received from the customer.

9. Our Liability

Nothing in these Terms shall exclude or limit Equestrian Stockholm’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

Equestrian Stockholm accepts liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.

Equestrian Stockholm is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these terms where such failure is due to an event that is beyond our reasonable control. Events including but is not limited to fires, floods, storms, riots, civil disturbance, war, nuclear accidents and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order on www.esstockholm.com shall be limited to the total price of your order.

10. Colours and measurements

We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

The measurements of items provided on www.esstockholm.com are only approximate values to give you a better understanding of the model or fit of that specific item, it is not a definite guarantee of the actual measurements of the item you will receive. The final measurements of an item may vary depending on the material used in its production.

11. Guarantee

If there are defects in the goods you have purchased, Equestrian Stockholm abides by all statutory guarantee regulations. 12. Assignment

Equestrian Stockholm reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.

13. Severance

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

14. Ownership of rights

All intellectual property rights, such as trademarks and copyrights at www.esstockholm.com remain with Equestrian Stockholm AB and its subsidiaries or licensors. Any use of www.esstockholm.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Equestrian Stockholm.

15. Governing law and disputes

This Agreement and accompanying Terms and Conditions shall be interpreted and applied in accordance with Swedish law. Disputes due to this Agreement and accompanying Terms and shall be settled by a general court in Sweden.
